Welcome to 43NB. These Terms of Service ("Terms") govern your access to and use of 43nb.com (the "Site") and any products you purchase through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site. By using the Site, you represent that you meet this requirement.

2. Products, Pricing & Availability

All products sold on the Site are made-to-order and produced through our print-on-demand production partners. Because items are produced on demand, we do not maintain traditional inventory, and processing times may vary by product.

We attempt to display product colors, designs, and details as accurately as possible, but we do not guarantee that your device's display will accurately reflect the actual product.

We reserve the right to change prices, discontinue products, or limit quantities at any time without notice. In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed.

Currently, we ship to addresses within the United States only.

3. Intellectual Property

All artwork, designs, images, and content featured on our products and throughout the Site — including reproductions of vintage band, artist, and record label artwork — are used under license or with the appropriate rights secured by 43NB. This artwork is the property of its respective rights holders and/or 43NB and is protected by applicable copyright and trademark laws.

You may not reproduce, copy, modify, distribute, or create derivative works from any artwork, product design, logo, or other content on the Site without our prior written consent. All other Site content, including text, graphics, logos, and the 43NB name and branding, is the property of 43NB and may not be used without permission.

4. Accounts

You may be required to create an account to complete a purchase or access certain features of the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. 5. Orders & Payment

By placing an order, you represent that the payment and shipping information you provide is accurate and complete, and that you are authorized to use the payment method provided. Payments are processed securely through our third-party payment processor(s); we do not store your full payment card details.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or issues with payment.

6. Shipping

Shipping timelines, methods, and costs are described in our Shipping Policy. Because our products are made to order, please review estimated production and delivery windows before purchasing.

7. Returns & Refunds

Our return and refund terms are described in our Refund Policy. By placing an order, you agree to the terms outlined there.

8. Reviews & User Content

If you submit a product review, photo, or other content to the Site (including through our review platform), you grant 43NB a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with promoting and operating our business, including on the Site and in marketing materials. You represent that any content you submit is your own and does not infringe the rights of any third party. We reserve the right to remove any submitted content at our discretion.

9. Marketing Communications

If you opt in to receive marketing emails or text messages, we will send communications in accordance with your preferences and applicable law. You may opt out of marketing communications at any time using the unsubscribe link in our emails or by replying STOP to text messages. Opting out of marketing communications does not affect transactional messages related to your orders.

10. Prohibited Uses

You agree not to use the Site to:

• Violate any applicable law or regulation
• Infringe on the intellectual property or other rights of 43NB or any third party
• Transmit any harmful, fraudulent, or unauthorized content
• Interfere with or disrupt the operation of the Site or its underlying infrastructure

The Site may contain links to third-party websites or services that are not owned or controlled by 43NB. We are not responsible for the content, policies, or practices of any third-party sites.

12. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the fullest extent permitted by law, 43NB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Site or products purchased through it. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the applicable order.

14. Indemnification

You agree to indemnify and hold harmless 43NB, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
